  1. It depends on the state. Some states require only one party to the conversation to be aware (that's called the "unreliable ear doctrine", if you talk to someone, you risk that they might be wearing a wire), others require that everyone knows it's being recorded. I don't think any states allow it if nobody in the conversation is aware, but I'm not sure. If you're recording across state lines, it gets still more complex. It also depends on whether you're dealing with federal or state court.

    I'm not a lawyer yet and cannot tell you how the law plays out in your situation. You'll have to find a lawyer who can tell you in your state.


  2. Yes you can, but that doesn't mean you can use it against them.  To use it IN COURT, the person has to be informed that you are recording them if it is in their shop.  Unless they call your house....then it can be used as evidence, since you DO NOT have to inform them you are recording them.

Recording conversations over the phone is called wire tapping and while the FCC really doesn't say that you can't record conversations some states and local governments do have laws against it so you will need to check the laws where you live at.   6. IF your MP3 player has  a microphone, yes you can record a conversation.  (Mine has no microphone ability.)

    There are many sound recorders that can do the job.  IF you want to  use the conversation as evidence this is possible.

    USING federal rules:

    # The recording device must have been capable of taking the conversation now offered in evidence

    # The operator of the device must be competent to operate the device

    # The recording must be authentic and correct

    # Changes, additions or deletions have not been made in the recording

    # The recording must have been preserved in a manner that is shown to the court

    # The speakers must be identified

    # The conversation elicited was made voluntarily and in good faith, without any kind of inducement.

    Most states have like rules.

    General rules of "recording" require that one of the principles be aware of the conversation being recorded.
