  1. Yes and No. It depends on how many cakes you are selling, to whom, and your Country, State/Province, County, and local jurisdiction. Generally if you are making a few odd cakes or pastries for family and friends and profiting less than a few hundred dollars no worries although you are technically required to report income. However, if you are baking regularly, or catering, you would be a business and you would have to file as such with the authorities and follow all health and safety guidelines. If you are a  serious baker I suggest you check with your County government what your business requirements are and with your local zoning officials. County Extension offices and State Taxation offices will have all the information you will need to get started. Start by going to your State or Provinces homepage and reading the business certificate/license sections.
