Can you sign away your parental rights without going through court?

I live in the state of texas and me and the biological mother of our child have met a mutual agreement that we want me to have no legal or financial responsibilty to our child. i dont want to pay child support and she doesnt want me to ever try to get custody but i can see the child. She is also engaged and wants the new guy to adopt. Upon speaking with my lawyer he claims this is an expensive process. im trying to find out if there is just a document that can be pulled up and notorized and both of us sign and be done with it.

  2. As long as theres a mutual agreement 'n a paper provin' that.. u don't have to take it to court. Thats what they want. They want the parents to work things out together 'n try to avoid goin' thru the courts. It should be fine!

  3. No, you need to go through the court system. But if her fiance wants to adopt the baby, let them go through the process for that, you sign a document that their atty will prepare consenting to the adoption and giving up your rights, and that's that.  No fee to you at all.

    - post the question in the law section and you might get a better answer

    - get a second opinion from another lawyer

    i'm sorry you're getting all these rude answers from people. most men in your situation would just turn a blind eye but at least you're facing the issue. but to be sure you don't want her knocking on your door when the new guy has left and she has no money so i'd say be absolutely sure that you're ok.  

  5. Actually, going to court is protecting YOU. You may sign away legal rights but you may still have to pay child support.
