Can you sue ex for back child support if there has never been a court order for child support?

My husband's ex girlfriend is trying to sue him for back child support. He has always given her money, apparently just not as much as she thinks she is entitled to. They have one child together, she is 9, they were never married, and have never been to court or had any legal papers drawn on the matter. He pays a certain amount of child support that they verbally agreed on years ago. Now she is saying it was not enough and is trying to sue him.

(I found this question and was curious to see what other people would answer, I have a friend going through a similar case in California. So I thought I'd re-post it). Thank you for your time.

  2. well for one thing he is @#$%@$ and up the creek with out a paddle. just some really good advice. if she has not filed anything in court yet he needs to get up there and do it first. anything can be filed in court threw a open court. they need to go to the clerks office and file motion to set hearing and to establish paternity it will go be for the judge  and a date will be set you don't really need a lawyer you can do any thing your self just look it up. but one thing is for sure if he just pays her cash that is not the best thing for him he has no record and she can make him pay every thing all over again. i sure hope you get this taken care of right away,and good luck!
