  1. if his car insurance takes care of your car then there is no need to unless there was broken bones or something but you have to make sure it was his fault and have pictures of the damages incase he doesn't decide to get your car fixed. going to need it in court no proof you get nothing

    If the insurance company declined your out of pocket or injury claim, you can initiate a civil or small claims suit.

  6. Sure, here in the USA, you can sue anyone for anything.  But if you've been paid by their insurer, you can't collect a second time from them.

  7. You can sue regardless of insurance.  If you are seeking compensation for potential injuries, you need to find out if you are even tort eligible.  What are your damages?  Do you have out of pocket expenses that have not been reimbursed?

    Remember, that when you sue somebody, the complaint will be referred to their staff counsel who will defend their insured.
