Canada, do I need a temporary resident visa?

My fiancee has been offered a job in Canada, we are both British Citizens. The contract is for 2 years. His new workplace will be sorting out his temporary work visa.

Myself and our 1 year old daughter are planning on going with him. He would travel there first and we plan to join him a few months later.

Do I need to apply for a temp residents visa? I won't be looking to work whilst I'm there.

I've read British Citizens don't need a visa to visit, but as its for 2 years do I need to apply for something. As we are not going to Canada at the same time, I don't think we can apply together.

Can anyone help?

  1. I think for a two year stay you will need a temp resident visa. I've researched this a bit and for stays longer than one year they "suggest" a visa.

I say "suggest" because the CIC web site is reluctant to guarantee they'll accept you under any circumstances.

However if you plan to return to UK once or twice, you may be able to travel without a visa.

  2. If you do not plan on working, you can enter the country on a Tourist Visa.  I thought the max stay on a Tourist Visa was 6 months, but some are saying only 90 days. These rules do change from time to time, to the Canadian Consulate/Embassy should have the ultimate answer.

In any case, all you need to do is leave Canada at the end of 90 days (or 6 mos) and re-enter.  Since most cities are so close to the US border, this is relatively easy to do.

The Border Patrol will likely want to see a copy of your return ticket.  Many flights now allow dates changes for $50-$100.  So get a flight that returns to the UK on the correct day (90 d, or 6 m), and then just keep updating that ticket.  Of course, this is only if you are unable to get a dependent visa.

The Border Patrol will have the ultimate say in whether or not you are permitted to enter the country.  As long as you don't have any criminal convictions, you should be fine.  Make sure to have all of your husband's paperwork with you if you plan on applying for an extension.  Our government is not generally in the business of refusing wives who want to be with their husbands -- they are more concerned about people trying to seek refugee status, or who may threaten the security or way of life of Canadians.

    Enjoy Canada -- it's a beautiful country!

  3. Friend,

    - From your case, I unserstand that you are not married and in this case you will not get DEPENDENT visa along wit hyour Fiancee [If you are legally married you can apply for dependent visa]

    - You are true, for visiting Canada, British Citizens do not need visa. But that visit would be for 90 days only.

    - If you want to stay more then that you should get TRV [Temp. Resident Visa].
