Canadian married an american?

my canadian girlfriend of several years is in her 50's and works as a grocery clerk. She is a single mom who struggles to get by on her own since a divorce many years ago..

an unplanned event happened when we were asked to join in on a wedding ceremony we attended here in the states and at the cheers of the crowd we decided to get married..we earn humble wages, are in our 50's and figured it was a great opportunity...so we went for it..

We are now learning of the legal issues we had no knowledge of concerning her right to live here with me and work part time in a minimum wage grocery job she has experience in for many years but hardly recognized by the government as a needed trade..

we cannot afford the fees associated with immigration...

The whole purpose was at the request of family and friends on a whim to live together and share that expense as older folk with low income to lessen our burden financially as individuals.

I have my own place i lease and work in maintenance for 3 churches and make an honest but modest living.

What legal issues to we have to face and what would are easiest route be.... afterall we are already married.

  1. I'm sorry to say that if your wife ever gets caught she will be deported unless you file the I129 or I130 to petition for her. That is the only way she will overcome the illegal presence she has accumalted in the U.S.

  3. I am in Canada so I could only help you with what you'd have to do to if you wanted to go live there but as for what I've heard about her immigrating to the US, you'd have to fill out a bunch of forms, might take her 3 months to get a work permit, cost around $1300.

  4. Prima facie evidence of visa fraud. deportation and a 10 year ban from US soil. I would look into moving to Canada or getting an anullment.
