Canadian resident in U.S.. help please?

I'm peruvian citizen and canadian resident. I believe I have to stay in Canada 2 of 5 years. Next June is going to be my third year in the U.S./out of Canada with a tourist visa that expired a year ago. My boyfriend is American citizen and he doesn't want me to go back to Canada, but if I stay longer than 3 years I'll lose my residency. We're thinking about getting married. How long will the whole process take until I get my green card/American residency?

I don't mind losing my Canadian residency as long as I get the American one.

Also, how long exacly do I have to go back to Canada in case we don't get married without losing my Canadian residency?

Is there anything I can do to also help my mom that is in the same situation but she doesn't have a boyfriend?

  1. You are an illegal alien in the US. If caught you will be deported to Peru and your Canadian residence revoked. You can not get US residency while in the US illegally. Fix your situation before you really s***w things up for yourself.


  2. as others have said you are an illegal alien in the US you will never get residency there unless you leave and apply the right way...........your mum too

    to keep your permanent residency in Canada you must prove you have been in Canada for the required time (730 days)in a 5 year period   or you will lose residency there........you don't mind losing your Canadian residency?  perhaps you would like Peru instead

    Canada allowed you to live there so respect their immigration laws and America's too!

  3. You are currently illegal in the U.S. You overstayed your visa by 2 years. You will be barred fro re-entering the U.S. for 10 years. Make a decision. You can't play all the countries simultaneously. What would you do if you got deported from the U.S., Canada didn't want you since you abandoned your residence, and were sent back to Peru? Ready for that? That is the path you are on at the moment.

  4. In order to keep your Canadian residency you must meet the residency obligations.  You must be able to prove that you were physically present in Canada for 730 days of the 5 year period.  I don't know if you can do this or if you have time to get the days in????

    You will not be able to stay in the uS legally as you have aleady shown them that you don't care about their immigration rules.  

    You really should get back to Canada and try to keep your residence there.  Your boyfriend can try to sponsor you for a legal status in the US but not until you leave.
