Canadian woman to marry a usa man?

last year i meet theis great lady in western canada on a work related trip.....we have keep in touch and became fast friends .. we have talked about her coming to live with me here in the usa .....but.....it appears it is alot of trouble getting married to a non-us citizen......what do we need to do to be married legally here in the usa.....can we get married with just her passport and her not have to travel back to canada?......what is our easiest route to become man and wife here in the usa

  1. My mother (American) married my father (canadian) and he had no toruble getting a green card. It is typically easier form Canada since visa's aren't required. Your immigration office will have the forms, or you can go online

You have to obtain a fiance visa for her.  She must remain in Canada while the visa is processed.  You will have to prove how you met, how long and how well you know each other, when and where you have been together, etc.  And you must prove you have sufficient income and assets to support her and guarantee a $30,000 bond.  It will take about a year to get the visa.

    If approved, she can enter the US and your have 90 days to marry and apply for a spousal visa.  She will probably get temporary leave to remain while that is processed.

    If you attempt to marry and follow any other procedure (e.g. tourist visa, marry in Canada, etc), she must return to Canada while the spousal visa is processed.  Since you will not be living together for a couple of years, it becomes very difficult to prove a valid marriage.

    Firstly, it isn't a lot of trouble to marry a non-citizen, it is just time consuming.

    You have two options:

    Option 1.

    File for a K1 fiancee visa by filing Form I-129F with the USCIS. This will take about 8-12 months to process and for her to get the visa in hand. Once she has the visa, she can use it to enter the U.S. and then you must get married within 90 days of her arrival. Once you are married, you then file for her adjustment of status by filing Forms: I-485, G-325A (x2), I-864, I-131 and I-765 - once she enters with her K1, she can then remain throughout the AOS and never have to return home.

    Option two.

    She arrives in the U.S, without a visa (Canadian citizens do not require one) and then you both marry. Once married you file Form I-130 and she returns home at the end of her authorized period of stay in the U.S. This route also takes about 8-12 months but it as many more advantages than option 1, namely she will be permitted to work and given residency on the day she enters the U.S. on her IR/CR-1 visa. The downside to this option, is that you will spend that 8-12 months in separation as a married couple.

    Both options cost around the same, both take around the same amount of time. You really just have to decide *how* you want to spend that period of separation; as a married couple or as an engaged couple but there will be that period of separation.

    You both need to sit down and decide.

  5. CPG is right. Go with his answer. My friend from Canada, married a man from Detroit, Michigan back in 05. It took a grand total of 6 months for her to get her green card.

    They married in Michigan and she ended staying there and being granted residency.
