Question:

Car Accident - Guy Wants To Settle After Insurance Got Involved?

I had a minor car accident where the side of my car brushed against this guy's car --> only a little paint comes off his corner. He jumps up and down & calls the cops. So i took pics with my camera & I then filed the report to my insurance company regarding the accident. A month later I received a call from my insurance that the guy wants to settle outside of a claim. What would be best for me to do? Should i tell him to kiss off? should i counter-claim? Thanks.

  1. Tell him (actually, tell your insurance company to tell him), to pi$$ up a rope. Your company is involved so for heavens sake let them handle this. Your company will protect you and insulate you from any mess this bozo is trying to pull on you.

  2. do not settle outside of a claim.  You have insurance, use it !  Don't worry about IF you get a rate increase or not.  People who have insurance and then don't/won't use it, use "fuzzy logic"

  3. The claim is already on your record.

Even if no payment is made -your rates could go up.

Usually its the at fault driver that wants to settle without insurance.  The fact that the guy you hit wants to do it...bothers me.

Most people that try to settle outside of insurance usually end up going back to the insurance. The at fault person thinks that the other guys estimates are too high and does not want to pay it.  It gets to be a mess. Most folks have no idea what the cost of repairing a car is. And it's much more expensive than you would think.

If you decide to just have your company handle the claim....just call the adjuster back and tell him you would rather they take care of it. If you need to, you can call the guy you hit and tell him that you would rather let your insurance handle this. This is what you pay premiums for.
