A little over a year and a half ago, my spouse and I where hit by an oncoming car. My spouse had some minor neck pain which subsided about a week later, however my pain lasted about a year and three or four months. I went to the ER, six months of physical therapy, several visits to message therapy and about five months of visits to the chiropractor. The offender's insurance accepted full liability. My Current medical bills amount to about $8,600. I have been sent to collections and have been having to pay these bills out of pocket. Also, I had many sleepless nights due to my injuries, not to mention the accident occurred three months after my wedding. How much would be suitable to settle for?

  1. i'm left with 5% disability fibromyalgia due to the trauma of the accident and 5 bulging/herniated discs and sciatica amongst the pain suffering depression, wage loss and my dead beat slacking lawyer only got me 50k, after paying my medical bills, lawyer fees and paying my parents back a fraction of the amount they gave to help me out I walked away with 10k

  2. Depends on the injury.

If you have what's called "subjective injuries", you're not going to walk away with a king's ransom.

If you have injuries that show up on film (external or X-ray), you might be able to leverage 70 or 80 large if your doctor indicates residuality.

  3. How much is fair can only be answered by you.  It is often a "whatever the traffic will bear" situation.

  4. Typical situation you have like many other people, therefor,be patient and check out the resource here i found useful.http://car-insurance.bestips.info/car-in...

  5. There is no set formula for bodily injury settlements.  Both of you have what's called 'soft tissue' injury which heals in time.  Big settlements come from disfigurement, loss of limb, fractures.
