Car Accident and Insurance...?

My fiance was in a car accident. A guy ran a red light and hit him. My fiance didn't have insurance, but the other guy does. My fiance got fined $500 for driving without insurance. Will the other guy have to pay for the damage of my fiance's truck since it was his fault or will my fiance get stuck with all the bills since he didn't have insurance? 2 people in the other car (guy at fault) went to the hospital with minor injuries (complaints of pain). What is going to happen?

  1. I don't think Indiana is a "No Pay, No Play" state, so his economic damages would be covered.

    Depending on Indiana's "joint and several" rules regarding passengers, he could still possibly by on the hook for a portion of any injury claim.   However, I am not familiar with Indiana's statute, if any.

First of all, he should get insurance because if it was the other way around he would be in a lot of trouble and would have to pay everything out of pocket on top of the possibility that he could be sued.  With that said, the other driver's insurance should pay but if not, look into filing a claim in small claims court for the damages.  And tell him to stop breaking the law and get some insurance!

  3. Yes he should get paid if the other carrier accepts liability. He should also be thankful he does not live in a "No Pay, No Play" state otherwise he would _not_ get paid.
