Car Accident in California, please help me!?

I live in Ca. I was leaving my mothers apartment today & when backing up and about 14ft away from the parking spot that I was in I hit into a car that was on my side of the road. A neighbor seen the accident and said that the other car was a fault being that I was already completely out (14ft) of my parking spot & the drive kept going which caused the side of his car to get scraped with the rear left bumper of my 08 Jeep. I'm worried from post that I seen that no matter what the incident is in the state of Ca you are automatically at fault when backing up. Is this true? Please help, I won't be able to sleep if I don't get any answers .. ;\

I've seem that scenario go no fault, fix your own on residential streets...same as parking lots.  People have to have Patience and give you room...

Its not true. + you have a wittness. take It to court. get your car fixed.

Go to sleep. Not sleeping will not change the outcome. Fill out the accident report and let the insurance co. sort it out.

Yes it will be your fault because with or without a witness you were backing out in the eyes of the law you need to stay in control of the situation...
