Car Accident with a DRUNK motorist with NO INSURANCE!!! HELP!!!?

I was hit head on by a drunk driver that was living out of his car. He totalled my car, and worst of all he doesn't have any insurance! I only have liability insurance, but my insurance company has told me that I am covered under my uninsured motorist coverage. This guy couldn't have gotten off this easy right??? I am still going to the doctor for my injuries. I am going to get paid for my car, but what about this guy that hit me? Can I do anything to at least punish him for what he did?

  1. If you have uninsured motorist property damage coverage on your policy you will be able to get your vehicle settled less your deductible. In you only carry uninsured motorist or UM it only covers you for your injuries/medical bills that you incur and will not cover your vehicle. Your only option would be to file suit for the damages to your vehicle, however, that too would be futile as you already stated the driver of the at fault vehicle was living in his car, so most likely he has no assets.


  2. You cant really do anything to "punish" him for driveing drunk with no insurance. Hopefully the Police were called to the scene and any further dealings with him will be by the cops more then likely for driveing intoxicated and driveing an un-insured and unregistered vehicle (I'm assuming he would'nt have registration)

  3. Unless he has some extra money laying around there is nothing you can do to him. However, once your company gets done paying you they will probably sue him, have his license revoked (if he has one),get a judgment against him etc.

    The state will also do some things to him, but unless he wins the lottery or his situation improves drastically he will for the most part get away with it. Thankfully, you had uninsured coverage.

  4. The unfortunate truth here is, you could sue him....but why waste the time and effort. What would you get from him. He obviously has nothing of value if he is living in his (now destroyed) car. Let the police deal with this loser and get on with your life.

  5. he'll probably just get a ticket. If you don't want him to get off this easy you need to sue him.
