Car Accident with no police report, no witness?

Hi all,

I just involved in a car accident with no police report, no car accident. The guy passed the red light and hit me on my back door on the right side. But when I called my ins. up, they said that the tow-car woman wrote on a piece of paper that it was my fault. And now they won't pay for my damage. Please advise.

Note: the police came to the scene, but didn't give a report because no one injures.

  1. A cop came to an accident and didn't file a report?  BULL**IT!  That's not possible, injuries or not.   The "tow woman" wrote down that its your fault?  And who the h**l is she "Judge Judy?"

    It sounds to me like you may not be from the US originally.  Go to the police station and demand an accident report and present it to your insurance company.

As far as the accident is concerned, the tow person is nothing--just tows the car.  What kind of company do you have that will listen to a "tow person"??????  The police should have done a report......it doesn't matter if there's injuries or not....with no injuries, in my state, it would be a 'Type A' accident.

Police are required to write a report if reporting to an accident scene.  The tow truck driver is not a recognized authority on ANYTHING!  Call the police and tell them you need a report.  Continue up the governmental chain until you get what you need.  In the mean time, call your insurance company and let them know they can work with you or your attorney, it's their choice.  You'll be surprised how helpful they're likely to become!

  6. I went through a similar situation. No police report and no witnesses. Her word against mine. Luckily it was her fault. What helped me was when both of our respective statements were taken by my insurance company; she accepted fault by saying she was in a hurry and that's why she ran the red light at the same time I was making my left turn.

    If I understand correctly, your insurance company is believing some tow truck person over you? That's a terrible insurance company.

  8. If you have collision coverage on your vehicle -- your insurance company will pay for your car, regardless of fault.

  10. I was involved in something similar a few years back.  Go to the police station and file an independent report.  The police and insurance companies should take it from there.

  11. the tow person has NO authority to say who is or is not at fault.  that's what the police report and the insurance companies are for.  if you have full coverage on your car you have the RIGHT to file a claim to have it paid for.  if you do this i guarantee your company will then look into who was at fault as they will want to subrogate to the other person for repayment.  if they still will not cooperate, go to your states insurance commission and file a complaint

    as for the police... they're supposed to file a report regardless of injuries.

  13. There is a call for the police to come out there. The tow drive is not allow to said who was at fauilt. It has to come from the police department. You should go dow to the police department. And tell them what going on. They can get the officer to write up the report.  Cause the were post to take note for a report. If they did not. Then they did not do their job. These officer are your case. No they will not give a report. You hap to go to the police department to get it. Even if someone was hurt. There is a report. I would get it and turn it over to your insurance company. But I would keep a copy for a aacident lawyer. If your insuance company does not come around. It the other car insuarnce company that pay in the end to fix your car. Second you can suil the tow company driver for his or her remarks. Cause they are not allowed to give out information on any aacident. Since they are not trained to do so.  And there is no place to mark this kind of infomation down on the two recorder. It sound like there is a bad fish in the mixs. This is also why I would see a lawyer. He can tell you how you should handler this. Most likely you will be going to court over this. And put some settlering money in your pocket and get your car fix or replaced.

  15. So you write on a piece if paper that is was his fault, and you'll be even.  Your insurance shouldn't have to pay anyway, the at fault person's insurance will pay.  So make a claim.

  17. its the police's job to file a report, i had this happen to me one time and i refused to leave the middle of the road until he filed a report and he got pissy with me but he did it!...and the tow driver cant say who's at fault, the police have to make that decision also.

  18. A police report probably wouldn't have done you any good anyway. A cop who comes to the scene after the accident happens has no way of telling who ran the light. (Of course the tow-truck driver's word is worthless as well). Do you have any witnesses? You might try going back to the scene and asking around in stores, at bus stops, etc and see if anyone saw it.

    If not, your best option is to sue in small claims court and hope the judge finds you more believeable than the other guy.
