Car Crash- was it my fault?

i was driving down the road and got to a three intersection stop (it was not a stop light) there was a car infront of me but he had no turn signals to i pull up next to him and he decided to turn to the right. when he turn he hit my car and scraped my car? he sais it was my fault but i say it was his fault for not putting on any turn signal. was it my fault?

  2. I would say that if it was a turning lane then he would have been at fault.

  3. You can only pass to the right if the other guys is CLEARLY turning to the left. As he didn't clearly demonstrate that, your pass on the right is considered unsafe.

    I would have waited behind him for about 2 seconds, then flash him the lights and see if he's ready to go.

  4. sorry to say but legally you should not pass on the right...but in real life the guy should get ticket for failure to signal

  5. Your question in not clear on one very important point. Were you in a travel lane, or were you passing him on the shoulder of the road?

    If you were in a travel lane and he turned right  across your lane, he is at fault! If you were passing him on the shoulder, you are at fault!

    The fact that he turned without signaling is not an issue here.

  6. If he entered your lane its his fault. Failure to yield to traffic.

  7. check me on this, but i dont think it is required to put on a turn signal.  dont ever pass on the right.  common sense would say he is responsible, but legally i think you are.  let the cops figure it out
