Car accident, driver at fault in denial

i was involved in a car accident last night. i had a green light going straight and the car opposite me attempted to make a left turn on a red light, unfortunately i didnt have time to brake fast enough and hit him

the problem is that he's denying he had a red light and there were no witnesses =(

any advice on what can be done would be greatly appreciated. i've already contacted his insurance company.

The problem: the police report will hold more weight than your word about what happened.  I'm sorry to be the bearer of bad news, but insurance companies don't like to pay out.  If you take the other driver to small claims court, you can sue him for the damages to your vehicle.  Take a video of the intersection and how it works for your evidence, then you only have to prove he was at fault because he definitely had a red light.  Good luck.

    (One concern:  was he already in the intersection *before* your light turned green?  If so, he had possession of the intersection, and he actually had the right of way.  That's the only thing that can make you lose this one, IMO.)

  2. Check to see if there is a traffic camera installed in the intersection. Maybe you'll get lucky.

  3. Firstly, I speak from experience only- I'm no attorney.  Contact your insurance company.  Explain what happened.  Tell them you won't accept any responsibility for this accident.  Even if the other guy had a green light, you had the right of way and he's at fault.

    Let your insurance company handle it from there.  Don't speak to the other driver's company, only your own.  If his companyothersto contact you, refer them to your insurance.

    It's likely the other guy's company will want to settle.  They may offer you 80/20 - 80% his fault, 20% yours.  I wouldn't go for it, if I were you.  Unless there is physical evidence you were somehow partially responsible.  Your insurance is supposed to be defending you on this, so make sure they do their job.  Adjusters usually just want to close the file and get onto the next one.

  4. If the other car was going towards you, you could not see the traffic light that was facing him.  If the accident occurred in your lane of traffic, there should be evidence, like skid marks or debris in the road.

    Let your insurance company handle it.  If credibility becomes an issue, offer to take a lie detector test and challenge the other driver to do the same.

  5. Sadly, in a he said / she said auto accident, it is impossible to prove who is responsible. I certainly hope you called the police. Remember the other person may honestly believe he had a green light. (no matter how illogical that sounds).

  7. Did you call the police at the time of the accident?  The police report should state who was at fault.

    If he was opposite you how do you know the light was red, you wouldn't have been able to see it.  It shouldn't have mattered, though, if he didn't have a green arrow, he should have yielded to you anyway.
