Car accident, who has to pay for passenger's physiotherapy??

Hey i got into a car accident, me and 3 of my girls were in the car when it happened. We were stopped and waiting for traffic to move when a car coming at full speed rear ended my car. One of the girls in the back seat of my car ended up needing physiotherapy and I dont know what to do. What does she need to do?? Her doctor told her my insurance company would take care of the expenses... is this right?? I was thinking the girl who hit my car would have to pay for it.

  1. If you were rearended it is the responsibily of the insurance of the person who rearended you to pay all medical bills as they are clearly at fault.


  2. Yes, the insurance company of the  person who caused the accident will cover it.  She needs to file a claim with the other driver's insurance company.

  3. Don't take medical advice from your insurance agent.  Don't take insurance advice from your doctor.

    Who pays for it, depends on what state you are in, and what your policies both say.  It's HIGHLY possible that you have to collect from your OWN policy.

    Call your agent.  Ask them for the information.  They'll give you state specific and policy specific information, which s accurate.

    This makes a HUGE difference in how it is handled.

    If you are in a PIP state (also known as "no fault") then the PIP coverage on your car pays for the medical bills for the parties in your vehicle.  You have to break threshold in order to go after the at fault drivers liability policy.

    Since we don't know where you are....your best bet is to talk to your agent. They should be able to give you some information on how things work in your state or refer you to an adjuster with your company who can answer your questions.

  6. The others insurance should pay, I hope you  have notified your insurance company of the accident.  If the others insurance for some reason, doesn't pay,then yours will.   Let your insurance company handle the whole thing.  That is why you buy protection.  Let them protect you.

  7. If you have medical coverage on your policy, they should be able to use that until they settle with the other insurance company.  When they receive settlement it's usually for pain/suffering & medical.

    If your policy pays out the medical & they receive it from the other parties coverage, they should have to pay your policy back.

    The parents of the child need to submit a BI (bodily injury) claim with the liable parties insurance company.

  8. The other person's insurance should take care of it if they were 100% at fault.

  9. Did she claim any injuries at the time of the accident? She may have to file suit agains the other driver. It should  be the other drivers responsibity, but you may have to go through a lot of trouble to get it.
