Car accident 4 years ago

the attorney had a friend of mine settle from a car accident 4 yrs ago, she has been having severe back problems, and now we finally have a competent dr., she has a fractured T11, he says from the accident.

Her new dr. has also mentioned to us malpractice, since her former dr failed to even diagnose to fractured spine.

Can we go back to the insurance company to help with medical on this?

  3. If she has signed a settlement agreement then it is probably too late to do anything with the insurance company.

  5. I Doubt It If They Already Settled The Original Claim. You Can Try With Your New Evidence And See What They Say Though After A 4 Year Gap I Doubt There Is Anything To Be Done?

  6. You already settled, so it is likely a closed case. Now if you want to go to get help with the medical take the current doctor's advice. Sue for malpractice to make up the cost of the medical bills. Did the insurance company recommend that first doctor? If they didn't then they have nothing to do with your bad choice, so why should they have to make up for it? That's why all the fault would be on the doctor and why his malpractice insurance should pick up the bill.

  7. Check the Statute of Limitation in your state on malpractice. It may have run out.

    Since you have already settled the lawsuit with the insurance company, you may have a hard time re-opening the case.
