Car accident advice?

i was in traffic lastnight, and i stalled my car, i restarted, but forgot to put it in neutral, and i bumped into the back of the car infront. now the person is trying to claim whiplash. will they be able to? i know it was totally my fault, but there was no marks on either of the cars, not even a scratch!! any advie appreciated!!

  1. what i would do is..call the person you bumped into, admit that it was all your fault and apologize sincerely. Be very friendly no matter how much they curse or yell. Tell them kindly that you will repair any damage done to their car and pay for their troubles as long as they don't report it. That way you still save money and your insurance doesn't go up. Something similar has happened to a friend of mine


  2. they can claim it all day long.  does it mean they are gonna get your insurance to pay for anything to do with it?  no.  insurance does not just hand out money.  they will investigate and find the facts of the accident.  the person will have to prove whiplash before your company will pay out for it.

  3. Yes, they can claim whiplash, but the insurance adjuster will make it known that they know there is no damage to either vehicle and they may not receive much money other than was is needed for their medical bills.

  4. They can claim it and go to a hospital and your insurance will pay for their bills. Even a bump at 5 mph can cause whiplash.

I had someone scratch my car door with their car door and I called and spoke to a cop about it and they said that unless I could prove it was done with malicious intent then there was nothing that could be done. Then the cop said that even if they had rear-ended me it was an accident and the other person wouldn't have needed to cover anything. I don't think that's true but call and ask a cop...

    And I really doubt they got whiplash. People theses days just seem to enjoy s******g others over.
