Car accident compensation

somebody hit my car seriously,his insurance company said,my car is completely lost,they will pay 3800,but I check the blue page,it said it is worth 5500,but the insurance company refuse to pay that much,they may want to force I send my car to their own repair shop to fix it,I do not trust them,what do I need to do?

  1. I am confused.  If they are saying the vehicle is TOTALED than they wouldn't be offering to repair it.

    If they are offering to repair it than obviously the damage is less than the value of the vehicle.

    Insurance is only going to pay for the LESSER of the actual value of your vehicle or the cost to repair it.  Also, if your car is covered in rust and/or has unrelated damage from accidents prior to this you will not get full Blue Book.

    If they are offering to repair it, I would send it to their approved shop.  Often their shops guarantee the work done on the vehicle for as long as you own it.  You have the right to chose ANY shop, however, if that shop is charging alot more than another, insurance is only going to pay a reasonable amount to repair the car.

    Get a quote from another shop and that will at least give you some leverage in demanding a different amount.

    I'm just going to say a damaged crashed car won't get full blue book value.
