Car accident help?

over 2 years ago i got in a "minor" car accident (someone rear-ended me) and i have been having back pain ever since then.

the other guys insurance is only offering $4,900 and 30% of that goes to our lawyer, $1900 goes to the chiropractor, and that leaves around $1500 for me, which for my pain does not seem worth it, i missed about 1 week of school cause i couldnt even get out of bed, i missed a lot of stuff i wanted to do

what is the advice from people of yahoo answers??

should i take it or hold out?

  1. unfortunately this is known as a 'soft tissue' problem and yea the MOST I've heard of someone getting for such a problem is around 8K - which doesn't seem worth it to me EITHER - as we'll suffer from this the rest of our lives.  Life's not fair is it?

    Hey I spend more on my medical bills (3K or just under) than the insurance company even offered me.  

    erase 3 K of your offer & you got the offer I was made - and $1181 of that was for my car...... :( :( :(


  2. Shouldnt you be asking your lawyer this?  Afterall your not giving him that 30% for nothing are you? (imagine if you got a keep that 30%.... do you really think that lawyer was such a good idea now?)

    Insurance only owes REASONABLE medical bills and  also doesnt even necessarily owe you more then your bills are.  People for some reason have this crazy idea that if their life was inconvenienced at all by the accident that they win the lottery.  So.. you missed a week of school and "alot of stuff you wanted to do"- you really think that your inconvenience is worth more then 1500? come on.. be reasonable.    Gpeople always tend to turn into money hungry monsters after an accident- they start thinking of bills that need to be paid unrelated to the accident, perhaps a car they want, and they start dreaming up this big scenario in their head of how their inconvenience is worth millions. In reality-    No amount of money can take away this accident.  Furthermore- Large settlement are for people who are paralyzed, have facial scars that will affect their looks for life, or that have died- those are the people that deserve big money.  It sounds like you had a minor soft tissue injury.

    Your lawyer wouldnt let you settle for less than he feels your owed.  So why dont you ask him if he thinks the offer will increase?  I have a feeling that whether you wait or not thought it wont.   It sounds very reasonable for a soft tissue injury to me.

  3. You did state that this was a minor accident.  You also mention that you only had $1900 in chiro treatment.  No xrays, MRIs or any other diagnostic testing?

    How long did you treat?  Based on the offer, $1900 for your medicals(specials) plus $3000 for your "pain and suffering", that you probably only treated sporadically for about 10 weeks.

    If you still have pain, which I really doubt, you should let your attorney know.  You may need to seek additional treatment.  If this is truly the case, you have more than a soft tissue injury and you probably should not be settling.

    Trust your attorney, he/she knows what your claim is worth.  In hindsight, you probably now realize you should have dealt directly with the adjuster.  You can hold out if you want to, but that does not mean that the offer will be increased.  Your attorney needs to prove with supporting documentation that your claim is worth more.
