Car accident.. help!?

so we were pulling into a rite aid, and the lady let us come threw when out of now where this guy is SPEEDING and slams into the side of our car. we were going about 5 mph. my sister is on crutches because of it.

now the cop said it was our fault becuase the man had the right away.. shouldnt the other man be to blame also because he was going against the speed limit??

and finally, our front tire is dented in, the window is shattered on the front passenger side and my father thinks the front end is out of line.. would u consider this a totaled car??

please help me

  1. It doesn't matter how fast your going out the turn, it is the fact that the people on the road that had the right of way, they couldn't see you.

    It would probably be deemed to be your fault, you have to wait for a time to pull out.

  2. The damage to the car needs to be evaluated by a professional body shop. Their estimate will tell you if the car is totaled or not.

    Many cars produced to today are design to absorb the damage of a crash by sacrificing themselves in the wreck. This means that many more cars today are totaled by what, in the past, would have created only minor damage.

    As for the other driver it sounds like you pulled in front of him and your assumption that he was speeding won't hold up in court without some type of concrete proof (maybe skid marks?)

    The odds are very good that a court would find you at fault or state no-fault.

  3. It is still your fault, you turned into oncoming traffic, that's the law and you cant do that.....

  4. Just because the 1st car squeezed thru, dont automatically mean theres room for you........like the cop said, it was your fault...
