Car accident insurance question?

I got into a very minor accident in November 2007. I hit the car in front of me at about 5 mph. The damage was minor (a few scratches on my car, not much more on hers). The woman reassured me she was fine, etc, and I believed her since the impact was so slight. I was notified a few days later that she had filed an injury claim against my insurance. Her own insurance covered her injuries, but my insurance still made her an offer of $500. Every month I get a letter from my insurance telling me that they keep offering her the $500 and she has made no response. Today I got a letter from them stating that she has 15 days to respond or they will "close the file".

Does that mean I am no longer liable? Or can she still try to sue me at some point?

  1. She can only sue you until the statute of limitations runs out.  In most states, it's two years from the date of accident.

    I'm guessing, with that minor accident, this is just going to go away.  You are still liable, but she can't COLLECT once the accident is too old.

    If they close the file, fine.  If it ends up that she DOES sue you, they will reopen the file again - not to worry.

She has until November 2009 to accept the offer or sue you.  Statute of Limitations for tort claims are 2 years.  Insurance companies will only pursue a claim so far before they close it.  Closing it doesn't mean, however, that you are no longer liable.  If she does make contact, they will re-open the claim, pay it then officialy close it once she signs a release form.

  6. if she don't take it than she cannot come after you on the 16th day.  statue of limitations are there for a reason.  anything else just see what happens other wise don't worry about it.
