This is in California. I stopped behind a bus which was behind railroad tracks.I noticed the other cars began to move and the bus didnt move for a while so I assumed that something was wrong with the bus, I checked my mirror and slowly inched out, when suddenly a car comes down the lane i'm trying to change into and i smash into it causing a dent from the right hand side passenger door almost to the rear of the car. We both immediately get out and i ask him if he's fine and he says yes. We pull into the nearest parking lot, exchange information and take pictures of our cars. Finally he writes up what happened according to him and told me that i had to sign the writie up. This is my first accident, i unknowingly like an idiot signed the statement after he read it to me. later on, i called his office, left a message if it was possible to fix his car in a body shop which i would be willing to pay...i dont know what to do now. im scared that i will be sued for everything i have. please help

  1. No police were involved? You should never have signed anything, it was his version of what happened, and it looked by signing that you were agreeing w/ him. I'd consult an experienced attorney and get to know your rights. You could say in court that it was under duress that you signed, and you didn't know exactly what you were signing. Good Luck

  2. You probably should have made a police report rather hen signing a piece of paper that is not legal. By signing a report he made is a biased view anyway and it really wouldn't help your defense if he did sue you. My suggestion is call and make a police report, not too late and give them his information and what had happened.

  3. Well I don't know about laws in California, but where i'm located at, if your in accident, you have either 24 or 72 hours to report it.. did u get a liences number or insurance info??

I'd report it rather they do or not..

it may cost you but maybe it will stop a nervous break down, and you'll sleep and not worry about it for days on end..

    GOOD LUCk

  4. You need to report this to both the police and your insurance company asap before, and it could happen, the other driver reports this as a hit and run on your part, do it for your protection...
