Car accident + not at fault + with two witnesses. Do I need to involve my insurance?

I was driving today in the far right lane of a three lane road. I must have been in the blind spot of the gentleman (loosely referred to as that) in the middle lane because without signal he merged into me.

He dented, scratched and scraped the front left (drivers side) of my car.

The car behind me stopped as a witness as did a woman on the street. This gentleman is claiming that he was already in the lane but both witnesses disagreed with him on the spot. Do I need to involve my insurance (I just got it yesterday) or can I just deal with his.... It seems like a straight forward situation.

  1. You can start by dealing with his. Sounds to me like this guy probably has already called your insurance too. Also, make sure both insurance companies have the information on the witnesses.


  2. You should always involve your insurance.  You pay a premium for coverages.  They can take care of your repairs now & they will approach the liable insurance company.
