Car accident question?

ok i was in an accident. 3 people (including myself) were involved. people stopped suddenly in front of me and i hit someone in front of me barely, barely touched, the lady didn't have insurance.

i was then hit by someone behind me, there was a good amount of damage to her car, but only big scratches on my back bumper.

we pulled over and i got the lady behind me's insurance, she had this kind of attitude like it was my fault like for example when we pulled over she stuck her head out of the window and said "ok i'm gonna need to see you guy's insurance".

does she have a chance of saying she's not at fault?

  2. No, you and her are responsible for "failure to maintain assured clear distance". You pay for the car you hit and she pays for your rear damage and her own damages.

She can say anything she likes, you can say anything you like.  Saying it doesn't make it so.  Fault is not determined by her or you or me.  Fault is determined by cops and/or insurance companies.  Don't worry about what others say.  I hope a police report was made.  Just report this to your insurance company and let them sort it all out.  That is what insurance is for.

    BTW, please do not Begin a question with the overused and un-necessary "OK"

  5. Usually in the case of a rear-end collision, the person behind ( or the 2 people behind in this case ) would be considered at fault.  The charge is usually following too closely.  

    When a collision does occur, don't try to determine fault ( but don't admit fault either... ) because that's the job of the police and/or the court.  Just exchange driver/vehicle/insurance information and either wait for the police or go your own separate ways and report the collision later ( depending on what your state/provincial laws are ).

    It sounds like she was trying to intimidate you ( which is unfortunately a common tactic I've noticed ) into admitting guilt.

Laws vary from state to state, but the woman you hit will be cited for no insurance.  Technically, she should not have been there (not legal) so you may not be responsible for her damage.  Your insurance Co. will probably have to sue the first driver to cover the damage to the front of your car.  Now...regarding the woman who hit you from behind, she is at fault because she did not have her vehicle under control.  If you rear-end someone you will almost always be at fault.  Let your insurance Co. handle it.  Good luck!!!
