I just had a car accident -with the person behind my car colliding on the rear end of my car. we exchanged insurance infos and i called my insurance and gave them the details.

1)do i have to make a police report regarding this- nobody got hurt (i still don't know if there's something going to ache on my body after this incident) ,

2)it was not my fault does my premium go up? ,

3) will there be a point against my driver's license even if its not my fault?

4) there was a mark on my car's rear end (not a big dent or anything) but i want it to be repaired tho', if it costs more than $750 will she be the one who's gonna get charged for it? do i have to make a police report then (if it costs $750 damage they say you have to make a report ?)

  2. 1)no

    2)no

    3)no

4)Her insurance will do the repair.your insurance will send you the paperwork needed to send to DMV.

  3. 1. You don't have to complete a police report, but I recommend it. The police report will contain all the information the adjuster will need to work the claim.

    2. Depends on your carrier. Your insurance should not increase if you are not at fault. It is a "non-chargeable" loss. The best person to ask though is your agent.

    3. No. Points are only assessed against your drivers license when you receive a citation.

    4. You have 2 choices. First, you can file a claim with your insurance company (if you have collision) and pay your deductible and your carrier will pay the damages in excess of your deductible. They will then inturn seek reimburse from the at fault carrier. Once they get reimbursed you will get your deductible back. The other option is to file with the at fault carrier. If they accept liability they are responsible for paying for your vehicle damages and providing your with a rental vehicle or loss of use. You will not pay a deductible. However, the at fault carrier will not be responsible for paying for the gas you use in the rental car or cover any additional insurance you purchase on the rental vehicle. Additionally, you may have to put a deposit on the rental vehicle via the rental car company that will be returned when you return the rental car.
