  1. If your friend has auto insurance he can make a claim under his own policy for Uninsured motorist. Providing he has that coverage.

If not, then he is SOL. Sorry

  2. He can and should sue the guy. If he wins,  He may be able to tie up the guys  future earnings.

  3. Lawnboy and Luna is correct. If your friend has insurance with Uninsured/Underinsured Motorist coverage, he may be able to file a claim. Otherwise, he will have to sue to get any money. Your lawyer friend is partially correct too. If the driver has no money, it will be very difficult to get any from him. Plus you are now paying for a lawyer, which will take their share from what little the student has, reducing the amount your friend will get to even less.

If everyone would just obey the law and get insurance, these things wouldn't happen.

  4. That is bull. He can sue the guy. Even though he doesn't have a job, he can sue for any medical bills, and damages. He will be held responsible and will have to pay it. Just because he cant afford it to, doesn't mean he doesn't have to. What idiot lawyer did you talk to? Sue that kid. He's parents will pay for it, or he will .

  5. If the person driving the car is a minor under 21 than the laywer can go after their parents

  6. Does your friend have uninsured motorist coverage, or does he have a household member with this coverage?  If so,  he may be able to file a claim under that coverage.

He can file suit, but it is unlikely he will ever see a dime.
