car accident without insurance but not at fault car parked in driveway and other car swerved into drive way and hit my car can I sue them", there was a witness, and a police report and the other driver got the ticket.

  1. If a vehicle has a state tag on it, it's required to have insurance. In addition to No Pay No Play states, MI would bar you from suing the other person for more then $200 or so (I forget the exact amount) as MI is a No Fault state for property damage.


  2. I agree all above. Good thing your car park on driveway doesnt need to have insurance. If park on street is require to have one. The other car should fix your car.

  3. Whose car was not insured?  Yours or the other guy?  There is no requirement you must be insured to collect from anothers insurance.

  4. Well, you can sue them!  But if you're in a "no pay, no play" state, the suit will be dismissed.   If you're NOT in a state like that, you'll receive the lesser of the cost to repair, or the actual cash value of your car.  Collecting, however, is another matter.

  5. no matter who was at fault, you should have exchanged insurance information, or at least get their insurance to fix your car. you were not at fault and should not have to pay to have it fixed. The fact that the other person was cited and given a ticket shows that they were at fault.
