Car accident;no health insurance-should we go to the doc?

Yesterday I was driving straight along a city road doing the speed limit, 30mph, and a car that was merging onto the road failed to obey the yield sign. He crumpled in the front side panel of my car. Other driver was doing about 25mph. Police came;gave the other driver a citation for failing to yield right-of-way. My 7yr old & 12 yr old children were in the car with me. Our necks , backs, & heads hurt today. My 7yr old also has knee pain for some reason even though he was sitting in his booster seat on the opposite side of impact. I don't have medical insurance right now. Should we go to the docs for this or just try to take aspirin/pain reliever & hope it gets better?

Note: I live in NC & I do have car insurance with liabiliy /collision/uninsured motorist.

  1. Yes go to the doctor. Inform your auto insurance of the accident. Tell them the police cited the other driver. The accident is his fault. His insurance will cover the bills. Do NOT pay for any doctors visits. Let the doctor know it was a car accident that caused the injuries and the other guys insurance will cover the bills. Your insurance company should help you in getting this done. Or you could just go to an attorney and they'll help you.


  2. go to the doctor then sue the other driver.  if you sue for over 8,000 dollars, you can't sue in small claims court and you need a lawyer.

  4. I cannot give you medical advice, but if you need medical assistance, use your head.  Go to the ER.  

    Contact the other party's insurance company and let them know that you and your family were injured.  They will let you know if they will reimburse you for your medical expenses.  If further treatment is needed, they do not have to pay as you treat, but they will likely agree to reimburse you for all reasonable medical expenses once you have all stopped treating.    

    However, NC still applies the contributory negligence rule.  Meaning, if you are found even 1% at fault for your damages, you may be barred from recovery.  

    No need to start suing anybody.  Contact the adjuster.  He/she will explain NC's tort liability system.  I believe it is verbal, no tort threshold needed to file a claim.

  5. you need to go to the doctor. See an attorney that will take this on. Most attorneys that take these cases on will not charge you a fee upfront but take a bout 30% of what you get. It will help your case alot to have personal injury. This is the only way the attorney will take it on. If they charge an upfront fee find another attorney. Phone book and web are full of these type of attorneys. Loncar is one. Look for the big names like the ones you see on TV because they are use to these law suits and can get you more money. Good Luck-but you must see an attorney and dont fool around with small claims court. You can get alot more money threw the injury attorneys. Do not pay for the medical. I would go threw an ER and asked to be billed. Tell them it is from an car accident and not your fault.
