Question:

Car and motorbike collision whilst car was turning right. who was at fault?

I was turning right from a side road. Traffic was heavy and there was a traffic queue on my right. The junction was therefore kept clear and I inched my way slowly to turn right. I looked right , coast was clear, looked left, coast was clear. Little did I know that in that short moment a motorbike decided to overtake the traffic queue on my right whilst approaching the junction i emerged from and hit my right front bumper. About 3/4 of my car was already in the proper lane. Who do you guys think was at fault?

  1. You say he hit your front bumper.  If you were at a standstill, he is at fault.  If you were both moving, he is at fault because he was passing you on the right, which is illegal.  If he was at a standstill and you hit him, you are at fault.

Not sure I understand your question, what is a queue? 1 question? was it the bikes lane that you entered? if so then it is your fault. if it was neither, then who had the right of way? you said you were at an intersection, that means you had to stop. so no matter where the bike came from, unless he ran a light or stop sign, then he had the right of way. it boils down to who was moving first? not like right of way at an intersection. if he was in an oncoming lane and you didn't see him, your wrong, if he was turning from another direction and you didn't see him then your wrong. the only way you are not at fault is if he blew a stop sign. or I misunderstood you. Hope this helps.

  3. It would be your fault, from what you said you entered into oncoming traffic.

  4. Even with the extra explanation something sounds wrong.  How does that bike, continuing on the main road, hit your right front bumper if you are turning to the right?  That should be the hardest part of your car for that bike to touch.

    I imagine from your description there is a shared responsibility.  You have a responsibility to be completely in one lane and it sounds as if you had not yet properly merged.

  5. The biker obviously, I've seen people on bikes weaving between cars on the highway... and by weaving, I mean speeding into the narrow spaces between cars that are traveling 60-80 mph.  I wanted to close-line the jerk.

He made an illegal move by passing you on the right (if i'm reading this correctly) so he was at fault.  I'm assuming a traffic queue is the same as a traffic meter (where you only go when it tells you to go to help traffic flow?) - if this is the case, then he is definitely at fault on both counts - passing on the right and failing to obey the signal since you seem to have had the right of way.   Good luck.

    EDIT:  Ok - so HE was on already on the street you were turning right onto.  I don't see how he could possibly have hit your right bumper unless he ran a red light and tried passing you on the right as  you entered the intersection.  Do you have any witnesses to prove he ran the light?  If not, you may technically be at fault since you were entering the road he was already on, but due to where he hit you it's going to be hard for him to explain how that happened.

    EDIT 2:   ENGLAND!!  (forehead slap)  NOW it all makes sense!!!  I have no clue what your laws are like in that situation  - sorry!!!  ;o)
