Car damaged when wind blew shopping carts out of store corrals at IKEA?

As anyone who has shopped at IKEA knows, the store's carts move at the slightest touch and maneuver 360 degrees easily.

A recent wind storm sent dozens of shopping carts rolling out of the store's cart corrals and flying across the parking lot, some stacked in rows of 20 or more. Several cars were hit, including mine.

I contacted a store manager to see if the store would take responsibility in repairing my car, which will cost about $500. He told me some of the store's own employees had also filed complaints about damage to their cars.

The storm had been going on for at least 40 minutes before the cart hit my car. If the store has experienced wind in the past, they know their cart corrals are insecure and tend to let the stacked carts fly out when weather gets severe. I think this fact constitutes at least some negligence since the store knows how its stacked carts behave in wind. Am I just on my own with this?

  1. They should cover the cost if not you could always go with a class action lawsuit.


  2. Are there signs in the parkng lot re no liability for damage caused by carts?

  3. IKEA would have no liability, the wind storm caused the carts to move.  Your insurance company should apply Comprehensive coverage.  

    Another way to look at it is IKEA was not responsible for the windstorm.  

    It is always worth trying to ask IKEA but I wouldn't be surprised if they said no.

    As a claims adjuster I would not pursue them for recovery.

    This might be an unpopular answer, but it is how the claims industry looks at it.

  4. Contact IKEA.  Work with them.  Also see  your insurance company and explain situation to them.  If there was no signs posted, then good chance that IKEA will pay for the damages.

Some have said that if the store has posted signs then they are absolved of liability.  I don't know for sure if they are liable or not but any signs they do or do not have posted mean very, very little.  IKEA and/or Their insurance should pay and if they don't your own comprehensive may pay.  Best to use your own insurance and have them and their lawyers go after IKEA

  6. Yes -- you are on your own. This is a result of the STORM, not the store. If you have comprehensive insurance you can file a claim for the damages (less your deductible, of course).
