Question:

Car dealer wants to reverse our deal and wants car back because they cannot get title to the car I traded for

now I am forced to take the car back and get my trade in vehicle back from the dealer. But now I will basically need to buy my trade in back from the dealer - so should I have to pay the sales tax on my trade in even though the dealership is the one that caused all of this to begin with??

Anyone familiar with this situation????

  1. No, you will not be buying your trade back.

    Any contract made by you and the dealership can not be completed because of the title problem.

    This means that you get your trade back and any down payment that you made. They get their car back and you both walk away.

    They may want you to pay for any repairs done to your trade in but you tell them that it was unauthorized.

    If you had a down payment, you should get that back too or tell them that you will contact DMV investigation.


  2. Is all the paper work done and finished with on the original deal? If so tell them to pound sand, there is a reason that the big portion of the paperwork is called a Contract, becuase it is a legal document. The only thing they can do is take you to court, and thats not going to go over well becuase it was their mistake, they will have to eat the lose, if you did nothing illegal your in the free and clear, although you may need to find another place to take you car for service, they may not be to willing to work on it after this.

  3. I would talk to an attorney about this, because if they want to unwind the deal they have to give you back all money you have spent on the deal and your trade in. You should not have to buy back your trade in, unless you owed money on it and they paid it off for you.

  4. Well for starters, they were in violation of the law by selling a car without having possesion of the title, they are screwed. You can almost tell them tough $hit. And if you end up getting your car back, you shouldn't have to pay a dime.

Here are the facts.  If they cant get a title, chances are neither can you.  This means you will never leagally own that car.  Do you really want to pay for a car you will never have a title to?  I know it sucks but you will never be able to sell, or trade this ar in if you cant provide a title.  Good luck, I hope it all works out for you.

They were in violation of the law by selling you a car with no merchantable title.  They would like nothing better than  to reverse the deal because they want to stay out of court and risk losing their dealer license.  So it is up to you.  If you want to reverse it, fine, do it.   I would ask for everything you gave them, pay no sales tax, no fees, no expenses, nothing!  and I would get some $$$ for damages and trouble and inconvenience.   If you don't want to do that then tell them that they can get you a title the easy way or they can get you a title through the courts the tough way but they WILL get you a title.  Seems to me you are in the drivers seat here.  Steer well !
