Car dealership never faxed info to the insurance company. Can anything legally be done?

I got in an accident in the car and the insurance company said the dealership never faxed the info and it was ultimately my responsibility to make sure it had insurance so is there anything i can do or am i just screwed with a wrecked car?

  1. You are the owner of the car.

    You are the policy holder.

    The insurance policy is a contract between you and the insurance company.

    Only - you- the policy holder can make changes to your policy.

    You should have driven straight from the dealership - to your insurance office - filled out any paperwork and paid any additional premium. You did not do that.

    It is your responsibility to make sure the car gets added to your policy and the additional premium gets paid.

    At the very least -you should have followed up with your agent to see if there was any other info they needed.

    Many policies give you 30 days from the date of purchase to add the vehicle. If you are with in that window - you may get lucky. If you are outside that window- you are S.O.L. and will be held personally responsible for the damage to your vehicle and any others (for which you are responsible).

    A 2 minute call to your agent THAT YOU ARE SUPPOSED TO MAKE, is ALL that was required.

    Even after the insurance told you "it's ultimately your responsibility" you're on here hoping some will tell you it isn't?

    It's your responsibility.  You didn't follow through, you didn't have insurance.  You had a wreck.  Why are you thinking you're screwed?  No one did that to you, it was a direct consequence of the choices you made.  I hope you have lots of cash on hand, because YOU are responsible for the damage.

  5. Depends on the time difference between purchasing the car, and the accident. In Utah, they are required to give you automatic 4 days full coverage and then extend liability for another 10 days. After that, you can try suing the dealership, but since insurance is a legal contract between you and the insurance company, the dealership shouldn't have the authority to be able to add it for your

  6. in arkansas--where i work--it doesn't matter if a dealership calls and gives us the information for a car...the insured still has to call and tell us to add it.  and then we still need their signature to prove that they wanted it added.

  7. car dealerships simply cannot change coverage on YOUR policy.  ONLY YOU CAN.   I dont know why people get so confused about this.

    To answer your question.  NO.  That was your responsibility and only your responsibility.

    The only thing dealerships do is check to make sure you have insurance to let you drive off the lot- agian- they absolutely can NEVER make changes on someones policy.
