Car in my name and somone else's name?

who has the right to the car? its actually at her house right now, do i have right to go get it, i have keys its in both our names..

  1. Yes, you have a right to get the car but no matter who "Gets" the car it is still owned by both of you equally

    .......Is the title worded John AND Mary....or is it .... John OR Mary ?

    If it is And, you both own it equally and both must sign the title to sell it.  .  If it is OR, you both own it equally but either one can sell it without the others signature.  


  2. Right now you both have legal rights to it and I don't think that cops would do anything if you took it. However she can take you to court and the judge would definitely take it into consideration which one of you drove the car on a regular basis, who paid for it, whose name is on the insurance etc. Also, if you have children with this woman and you are taking her transportation away without saying a word and coming to an agreement, they would frown upon your action.

    If you want the car, you will have to pay her half the current value of the vehicle and have her name removed from the title. If she wants to keep the car, she will have to pay you off.

    It is never a good idea to act out of anger or spite. It is better for everyone to come to an agreement like decent human beings... in or out of court.
