A yesterday a women was driving through the hospital car park looking for a car parking space and i was behind her in my vehicle. She suddenly stopped as she may of thought she found a car parking spot and reversed into me. there was not much damage [a bit on the bumper] but today i have back pains. I rang her today and she said she would pay me £50 and didn't want to go through insurance. Now i am in the dilemma on wither to accept the £50 or claim for injury? Can i claim in this situation? Any advise will be helpful and thanks in advance.

  1. take the £50

as she can turn around and claim that u ran into her from the back, and its always the person who hits the  back at fault

  2. If you were stationary and there is very little damage {a bit on the bumper} - your words.  Then I think you're coming the game.

However, if she is so willing to pay you £50 then I would be suspicious about her insurance, like she might not have any

  3. If you are happy that you were stationary and the other driver reversed into you just report the facts to you insurance company and let them sort it out that's what you pay them for.

By the way you are obliged to report all accidents to your insurance company even though you are not making a claim on them.

  4. If she reversed into You then I'll assume that You were stationary. If this is the case, You have the right to claim without fear of Her winning. If this is not the case, take the 50 and drink until it doesn't hurt anymore.

  5. Take the money & run.  -0- damage to both vehicles & an injury, any insurance adjuster will give you a hard time about that.  More than likely they would decline your bodily injury claim.

  6. my advice is to seek medical help and go through the insurance because never know what damage has been done and besides how far can 50 quid get you if you go private because insurance companies send you to get any injuries checked out and they pay for it,
