i got rear ended in a brand new car that i leased. the only thing that was messed up on my car was the bumper so the damage on the car is not that bad at all. i just need a new bumper. the person that hit me did not receive a ticket but a police report was filed so i was wondering if my insurance will cover me or not.

  1. What you will want to do is file a claim with your insurance. They will determine who was at fault and if they find you fault free, then they will pay to fix your car and will go after the other persons insurance company themselves.

  2. Your insurance company should try to get the other driver's insurance to pay and the other driver should be paying for the deductible.  If the other driver has no insurance, you will have to sue the other driver (considering he/she is at fault), for the repairs if he/she is unwilling to pay.  If you sue, sue for the entire repair cost, not your deductible amount.  When someone else is at fault, you have the option whether you want to use your insurance.  Make 'em pay the total cost of repair.  In most cases you are required to get at least two estimates.
