Question:

Car is going 115 mph and the passenger purposely jerks the wheel & car is totalled, who caused it? is at fault

True story, and I need honest opinions and maybe even legal opinions. No answer is wrong I just want to hear honest answers.

So the situation is this: I am driving the owners car very fast 115 for a few minutes totally maintaining a straight line and not swerving. the passenger and owner of car screams for me to slow down and I jokingly hesitate and continue maintain 100 + speeds. With all plans to slow down and not at all thinking it to risky I continue driving fast (110) she then in an attempt to do who knows what...??? She grabs the wheel and we slam into the jersey barrier at 115 (flipped, burned you name it the car did it) Also know she asked me to drive because she had been drinking. Who is at fault and why?? Who is the cause and why?? who should pay for the car and why?? I would really appreciate honest answers and any legal answers as to who is liable. Do know the story has a happy ending and driver and passenger are still together years later..

  1. unless you were on the autobahn in the middle of the day, you shouldnt even be going over 80 mph, so its on you dude


  2. I really think you are at fault. 1) you should not be driving that fast. So when she asked you to stop, you should of. Who knows her reasons. She was drunk.

    2) if you would have been stop, for fast driving, you would get the ticket, not her.

    3) you were in charge of the car. You should have control over it at all times.

    But, if it was me, I would point out to the person, that you were driving, and fast, but you still need the proper time to slow down without locking the breaks. And she should have not grab the wheel. So both of you should pay for it.  Also you could point out that she was drunk, and had no right to touch the wheel. So if it comes down to it, she also might be in trouble.

  3. i say u both caused it. u shouldnt have been going that fast even though it is temping, trust me i get those urges too, and u should have slowed down when she said to and she shouldnt have grabbed the wheel especially at those speeds

    Really.  IMHO and from a legal standpoint as well.

    Why.  1.  the driver was "wrecklessly indifferent" and purposely exceeded  the maximum safe speed for the conditions.  and 2.  the passenger caused an unsafe turn which resulted in the loss of control.   the passenger could have also just yelled at you, startling you and cause a collision, they would have still had partial responsibility.

  6. Since you were the driver, you were at fault.  You are supposed to maintain control of the vehicle and your passengers at all times.

  7. I would say nearly equal parts to both parties involved. You for driving extremely recklessly at 115 MPH and her for jerking the wheel. Two stupid people controlling a car equals trouble which you have provided proof of.

  8. This isn't the answer you want to hear.  I believe the driver is responsible for every aspect of that vehicle INCLUDING the behavior of the passengers.

  9. I don't think it was the jerk from the passenger...I think it was more the fault of the JERK behind the wheel.

    Know...would you have wrecked had he jerked the wheel at 55 MPH...if not...then maybe the speed had something more to do with the wreck.

    Guess what?  The driver is at fault for driving at a reckless velocity and not maintaining control.  I am glad everybody lived.  Often they don't.

    You're a nice friend!!

    YOU drove your friend's car at a speed that she thought would jeopardise either her, the vehicle or both.

    YOU, having been s-c-r-e-a-m-e-d at by the owner of the vehicle to slow down and with the realisation that her judgement was impaired through alcohol, continued at the high speeds that were causing her distress.

    The distress that YOU were causing then prompted your alcohol impaired passenger to do something more drastic - as YOU had "jokingly(humour???)" ignored her wishes and continued at over 100+mph - ending in your accident.

    1) Too fast

    2) Alcohol impaired and scared passenger

    YOU are at fault and YOU should pay!!!!!

    People like you should not drive. At least your more intelligent friend had the good sense not to drink drive.

    I actually DOUBT that the HAPPY ENDING exists though, THAT YOU ARE REFERRING TO A CURRENT SITUATION  and you are just looking for a way to weasel out of paying for YOUR STUPIDITY!!!!!

  13. You both are. You were breaking the law by driving 115 mph,a very unsafe speed and going too fast to have any time to avoid any crash. And the passanger is at fault for jerking the wheel. Its a good thing you 2 didnt kill anybody
