Ok..I had purchased a truck for my daughters ex-boyfriend we are both on title but he is only on registration. He is not paying, so teh Dealership is getting me on the registration as (or). If I am on the registration am I allowed to take this truck and trade it in to the dealership. Before I couldn;t because I wasn't on registration, and he wanted me arrested. I have been making payments etc.. I want to make sure I can't get in trouble agin for taking the truck. I am stressed, because this kid doesnt care about my credit. I have a court date in small claims but not for another 2 months, so far he owes me 2000.00, What do you think I should do take the truck now or wait for court date.

  1. Or means he can trade it in too. In the future, you should have put AND instead of OR

Where does your name show up on title, are you listed as legal owner and he as registered owner? In California for two people, it would be one party "OR" the other on the title.

If you're on title as a lienholder, you can take possession of the vehicle.

Furthermore, it doesn't really matter how title is right now, if it's "And or, Or" . . . either one of you has a right to possess the truck, drive it, park it, garage it wherever the other doesn't even know about it.

Call your local police dept. and talk to the watch comander, or someone they connect you to. Brief them on what's going on and they'll advise you. And then, I think you'll want to call or go in to a tow company and see how they'll advise and assist you in your goal.

Don't waste any time with attempting to modify the registration as if anything were to happen through the ex boyfriends neglegence, you're also financially responsible and may lose everything you have over it. So make those calls without any further delay on your part.

    Good luck, Rich

Considering all the above, I also wanted to add that even as a cosigner you have rights. Call your County Bar Association and for $30.00 dollars or so, they'll put you in contact with an attorney who will give you 30 minutes of their time in advising you of your options.

  3. If the truck is under both of your names as (OR) you have every right to go and trade in that truck. He is not making the payments so you have a good case.

  4. As long as you're on registration, it's just as much yours as it is his.
