Question:

Car tax question?

I bought a car with a tax disk on it and I'm new to driving so I didn't check the details on the tax disk as the car dealer was somebody I thought I could trust. Then I get a letter from the DVLA saying that it was seen untaxed and want to know details about if I was the registered owner at that time so I thought it was a mistake. A friend said to check the details on the disk and opposite the price is a reg different to my own. What am I supposed to do now?

  1. That is really suspicious. I think the disc might belong to a scrapped car. I don't think it is stolen, since DVLA would know about it. But I am not sure. The best think you could do is call them and discuss the issue with them directly.

  2. Tax the car. It's untaxed and you were conned.

However you should report the matter to both the DVLA and the police, because it looks as though someone may have committed a criminal offence.

  3. Did the person who sold it to you tell you it was taxed?

if so and especially if you have it in writing on a receipt or somewhere it comes under the trades description act as this means it should have been taxed as stated and if as in your case it wasnt you can ask the salesman for a refund for the supposed road tax and threaten to take him to a small claims court. It costs to go to a small claims court and although you get your money and costs back if you win, it can take months. Did you have a witness with you if he said this to you verbally. If nothing was said or written down re the car tax, then it is your responsibility to check. You can contact the police and tell them it was displayed in the tax disc holder fraudulently but this is only an offence if the car was displayed on the road - not on a garage forecourt. when these things happen to us it makes us sharper next time which is a positive thing!

  4. The first thing to realise is that someone has pulled a fast one on you.  When you buy a car you must be given, with the car, its registration document and you have to inform the DVLA in Swansea, on a tear-off part of this document, that you have taken possession of it. If you fail to do this, as I did,  you are breaking the law and will be fined, as I was. The fact that you have had a letter from the DVLA means that someone has "grassed you up" by telling them that your car is untaxed.

If I were you I think I would be inclined to have a word with the police about your situation because I feel that a crime has been comitted, perhaps by the person from whom you bought the car.  Receiving stolen goods and/or driving a car without tax and/or insurance are all criminal offences and you should try to make sure that you are not the one prosecuted. After all, it would appeara that you bought this car in good faith.

  5. You may find the car is stolen.

Better contact the police so they can take a look at it.
