Casey Anthony arrested, death penalty?

Casey Anthony was taken into custody just a few moments ago. Though she has not yet been charged with murder, IF she is and proven guilty, can she be given the death penalty?

  1. 1st degree murder does not often result in the death penaly here in Florida as was previously mentioned. The State Attorney's website shows, with some basic math, that only 1 out of every 351 people convicted of 1st degree murder are sentenced to death. Only 1 out of every 177 people sentenced to death are ever put to death by the state. In the other cases, either the convicted dies before there sentence is carried out or the sentence is converted.

    Also, 1st degree murder, which is the only criminal offense in Florida that will get you the needle, is very difficult to prove in a case of this nature. Unless Caylee was murdered in a way that can be proven through skeletal remains, I suspect the most severe charge Casey will face is manslaughter. It has become apparent, given the most recent of law enforcement tactics such as partial immunity and picking Casey up on "economic" charges, that the prosecution believes this was an accidental death.


  2. I believe Florida does have the death penalty so theoretically, yes, she could.

    That's assuming the district attorney doesn't offer some sort of plea deal - if she'll plead guilty and accept a life sentence with no parole, they may take the death penalty off the table.

    I'm not going to say what I think they should do to her, but it involves bullets and starting at the toes and a lot of pain and a lot of days before she dies.  

  3. I am from FL and let me tell you that state is VERY soft when it comes to law.She will probably not be given the death penalty.I dont mean to sound biased towards FL cops its just I have reported many outrageous things that happened to my sister to the cops and they did nothing about it.

    This is just one thing Ive had to deal with,my mom was beaten and I reported it and they did nothing.My brother was molested and the cops do nothing.

    FL cops = soft and dont do theyre job

    First Degree = premeditated murder, which is most likely the death penalty in Florida.

    Second Degree = Not premeditated, but the reason must be know to see if it warrants the death penalty or not.

    Third Degree = Accidental death, and usually no death penalty.

    It could have been third degree murder, but her silence is causing her to cover up the crime.  

    Her Lawyer has advised her not to talk to anyone about this because it will definitely be used against her.  It is up to the Prosecution to prove she is guilty.

    So far, having lied in different alibis, and discovery of decomposed human remains in the trunk of her car are helping the Prosecution build a case against her.

    Sometimes, a deal is made to avoid the death penalty, by disclosing all the details and leading authorities to the body.
