Chances of going to jail for the remaining probation time?

Okay, I'm one month into my one year probation [for theft]. It is my first offense, a D Felony, and once a year of probation is up, then it will be turned into a misdemeanor. I have to report to county A. [Thus far, I have taken the required classes I've had to take, and been free of all drugs.]

I also have my license suspended, and yesterday, I drove up to the gas station, and rear ended someone. It was a company vehicle so police were involved. The police officer gave me a court date, but did not take me to jail. I have court in county B on September 10. I was very honest with the cop about everything.

[I live in County B, and County A is like than like a mile away, so I was wondering if there would be some different outcomes for this]

Any idea of the chances I'll spend the remaining probation time in jail?

Any ideas of how this will effect my D felony being turned into a misdemeanor after a year?

  1. I got caught driving while suspended and they didn't do much about it.  It is ridiculous.  They tell you that while on probation you have to do all of this stuff but you cannot drive.  Anyway, you have to tell your probation agent.  If you don't, you could get in worse trouble for not reporting it.  Eventually, they will find out.  You must tell them what happened.  If you are honest, the situation will be better to deal with.  They will not put you in a jail for a year, I doubt it.  You might do 30 days.


  2. You need to discuss this with your PO as soon as possible. You have violated another law and are on probation so the judge is not going to be happy, or lenient with you. Since you were "unlicensed", you could be considered uninsured with your companies insurance company. This could get ugly.

  3. It would be 50/50 at best.  To many variable to say.  Biggest is, how well do you get along with your PO? Another is, how big is his case load? Another, how well do counties A and B communicate?  I could go on forever.  Best guess, be prepared either way and everywhere in between.  You could do the remainder of the year, you could have to do only a weekend or two, they might even drop it and let you pay the fines, if any.
