Question:

Chances of receiving unemployment?

I started receiving sexual advances from a co-worker at my job. When it crossed over into my personal life and threatened my relationship at home, I spoke to the general manager of my job and told him I had been harassed. I was due to leave for vacation later that week and he told me to go early and call when I got back. The day I returned home, after keeping in contact with several of my co-workers, I was fired. They decided to keep the harassing employee instead of me because of my lack of experience. They also said I had several absences even though I was told my shifts had been covered. I filed for unemployment because it is extremely difficult to find a job in my town. I have already dropped off applications and resumes to over 20 employers so I am trying really hard. What are the chances I will receive unemployment? I noticed I had to explain why I was fired but I have a feeling the company will lie. How will that hurt my chances? How does unemployment work? I am only a 21-year old student. Any answers will help.

  1. You need to see a lawyer. Soon.

I'm sure it depends on what state your in and their specific unemployment laws. If you were fired, in CA for example, you are not eligible for unemployment (I'm pretty sure). You would have needed to have been laid off.

If you can, talk to a lawyer. Contact your local District Attorney's office or a pro bono office and schedule a meeting with someone who can advise you as to the next steps to make. If the story played out like you said it did you should not have been fired and, if you want to, I'd imagine you would have a case against the business that let you go.

    Good luck.
