Change a year lease to month to month? Please help.?

How can my renter and I mutually change her lease from a year lease to a month to month? Should we sign a form I have called Mutual agreement to end a tenancy and then I sign her onto a new month to month lease? Also how long is the time given to her or to me to end the month to month lease?

.    Do exactly as you outlined on a plain piece of paper and the lease is gone.  But you are slipping into a mistake by asking when you can end the month to month.   That would be turning it back into a lease.  A month to month does not have an end.  It ends when one person gives the other a 30 day notice to vacate.

Many leases contain a clause that allows the lease to rollover into a month-to-month, with nothing else changed.

If you want, you can merely drag out a fresh copy of the lease and strike out any mention of the term and write in "month-to-month" (and both initial the change). Then sign at the bottom.

As far as notice to terminate a month to month lease, you need to check your state's landlord tenant laws.

The required notice varies greatly, from 7 days to 30 days.

You don't need to terminate your original lease. Just write up a simple addendum to the lease saying you're chaning it from a one year lease to month-to-month. Make sure the addendum states that all other clauses in the original lease remain unchanged and be sure to state the names of all the people who signed the original lease and the date on the original lease so you know your're referring to the right document.

On a month-to-month agreement either party can give the other 30 days notice to terminate the agreement.

Anything can be changed about the lease at anytime if both landlord and tenant agree to it. Type up an addendum to the lease stating that it is now a month to month lease and that all the other terms and conditions of the original lease remain the same. Make sure both parties sign it have a copy.

With a month to month either party can terminate with 30 days written notice.
