My son is 5 years old and his biological father has not seen him since he was 8 months old.. My husband has taken care of him since he was 1 year old.... My husband and I have two more children together and we all carry the same last name but my 5 year old does not... My son asked for the first time his last name is different... I want to change it to my married last name... My sons biological father says he would sign the papers for my husband to adopt him... I want to change his name by adoption.. How would I go about doing this??? How much would it cost??? Would I need an attorney??? I seen answers to other similiar question and the answers mention a petition.... How do you put in a petition and can you for adoption also????

  1. I believe its fairly easy. Here in CA you would go down to the Social Security office and fill out a form and pay for the new card which for the first replacement is $10. And Voila you're a new person.

  2. It should be done in the adoption process.
