Question:

Change employer on EAD / AC21?

My I-140 and 485 was applied in jul/aug 2007. I got my EAD in October 2007. But I-140 was approved in May 2008. I have an offer for a new job with a new employer. The proffered wage on my labor is $50.88/hour. But the new job offer has a salary of $90000/year. This $90000/year is less then 50.88*2080($ 105830.4: the anual salary at $50.88/hour).

Now I would like to know what exactly what the new employer will have to do and what I will have to do to join the new employer.

Thanks in advance.

  1. If an employer sponsors someone for a visa or for immigration, the person they are sponsoring may NOT change employers. To change employers, you would need to find another job, and have that employer apply for your visa, then change jobs.  But applying for a new visa may automatically cancel the old one, and you cannot stay without a valid visa.  Generally you have to go home while the new visa is processed because there is no leeway to remain in the US once a visa is cancelled or a job terminated.  Tough juggling act with a maximum of ten days to start your new job with new work visa.

If you are a legal immigrant with a green card you got on your own, without an employer's sponsorship, you can change jobs any time you want.
