Change of status/immigration issues?

came to the US on an F-1 visa, missed a few semesters and go out of status. However, while I was still in status, I filled out form I-130 as i have a sibling who is a citizen by naturalization. question is if im out of F-1 status, can i still transfer to another college based on the form I-130, which is still pending approval? Really just want to complete undergrad and go home! thanks for the help

  1. Do you know how hard it is to get a visa to the US?  There are quotas for these things.  You getting a visa meant someone else didn't.

    You should have thought of that first before you "missed a few semesters and go out of status"

  2. Your best bet is to go talk to them about it. They are rather helpful people.

  3. If you are in our country illegally you must go home.


  4. You are currently out of your status. Filing I-130 even if it is already approved doesn't give you any status. Beside, sibling sponsored family immigration takes from 11 to 22 years of wait until you get to file I-485.

    If you want to finish the school, you need to get admitted to college and get I-20. And apply for F1 status again.

    Consult with immigration attorney for the proper procedure.
