Charged with domestic battery( First Offense, No Criminal Record)?

What are the chances of a domestic battery charge being lessened to court supervion or probation! Never been in trouble before and it was a first offense. I've also been thinking about arguing the charge in court(via lawyer). But if I decide not to, generally what king of consequences are there? My boyfriend called the police and said I attacked him. He had a scratch on his neck and he said I kicked him. We had actually scuffled earlier that day over my car keys. I cut my foot and thats where his scratches came from. It was a mutual tussell so to speak but I was arrested because he called the police. I live in Illinois and Im not sure how that works?

  1. First of all he doesn't care for you or both of you would have never been fighting. Try to find a lawyer and learn from this.


  2. well thank god u have a lawyer hopefully not a pd(public defender. More then likely i say you should fight this case. will your boyfriend really show up if you go to trial? If not then the case will get droped. Ask your lawyer for a speedy trial and stay in good with the boyfriend until then and ask him to dodge the supeona he will get served with. Then dump his sorry *** because that is way to much bullshit for u too go through. Believe me I went through this with my husband but he actually showed up for court. *****! I know... now im charged with a battery case and have to do domestic violence classes. I live in Illinois as well.

  4. works different in every state but if you werent at fault then fight it.. and it all depends on age and well alot of stuff... but just keep your story straight.. id contact a lawyer if your innocent

  5. since it's your first offense, it's a class A misdemeanor. You could go to jail for up to a year max.

  6. plead battered woman syndrome, tell them he's been beating you for months and you just snap, you're leaving him anyway right?

Under Illinois law, domestic battery is a Class A misdemeanor, so you could have done a lot worse, but if you want to fight the charge or determine what bargaining power you might have to reduce the charge, you will have to talk to a lawyer. You will be provided with one if you cannot afford one. It might also help if you could convince your boyfriend to contact the police and/or prosecutor to try to get the charges dropped.

    Maybe this is too obvious to point out, but you probably shouldn't be getting into a physical altercation with your significant other.

    It seems very unlikely to me that you're facing any jail time.
