  1. black player wins in case of a draw no draw has to be offered the rules say smoke before fire therefore black moves before red unless less red has more pieces off the board


  2. According to the US Checkers Federation:

    "A draw is declared when neither player can force a win. When one side appears stronger than the other, and the player with what appears to be the weaker side requests the referee for a count on moves, then, if the referee so decides, the stronger party is required to complete the win, or to show to the satisfaction of the referee at least an "increased" advantage over his opponent within 40 of his own moves, these to be counted from the point at which notice was given by the referee. If he fails to do this, he must relinquish the game as a draw."

    There have also been interpretations in the past that if the board position repeats 4 times, then it's a draw, but I'm not sure I can verify that.

    if a move is repeated, to the point where no conclusion will be made for either player, a stalemate is called, usually.

    These are some of the rules for Standard American Checkers.

    A player wins by either capturing all of the other player’s pieces or putting them into a position where they cannot move.

    A player can also win if the other player resigns or forfeits the game as a result of a violation of the rules.

    A draw can be declared any time both players agree to it.

    A draw shall be declared if a player can demonstrate that with his next move he would create the same position for the fourth time during the game.
